DEFINITIONS

Vehicle – means the Vehicle described in the Rental Agreement which the Hirer has agreed to rent from Drive SA Car Hire also any other components with the Vehicle (spare tyre, jack, tools, booster seat or baby capsules, GPS Supplied by Drive SA Car Hire)

Hirer – means the person or persons who have signed an agreement to rent the Vehicle from Drive SA Car Hire.

Drive SA Car Hire – is the owner of the rented Vehicle and has total rights to the Vehicle.

1. CONDITION OF VEHICLE

a. Vehicles are NON-SMOKING.

b. The Hirer agrees that the vehicle is in a roadworthy condition. You also agree to return the vehicle in the same condition except for the acceptable wear and tear.

c. Hirer will maintain oil and coolant levels and tyre pressures while the vehicle is in your possession.

d. Hirer agrees that if a service or warning light is illuminated on dash that you will stop the vehicle and turn off engine as soon as it is safe to do so, and contact Drive SA Car Hire as soon as possible.

e. Hirer agrees to report any problem or defect to Drive SA Car Hire as soon as practical.

f. No repairs must be undertaken on the vehicle without Drive SA Car Hires prior approval.

2. USE OF VEHICLE

a. Hirer must use the vehicle in accordance with road rules and not use in a way which will cause Drive SA Car Hire insurance to be void.

b. Vehicle must be only driven on sealed roads, any under body or overhead damage will be repaired at the Hirers cost.

c. The Hirer will be liable for any window damage, broken mirrors or aerials. Tyre damage by hitting curb or other method will be covered by the Hirer.

d. The vehicle must not be used to transport goods, be used for hire or reward, and no animals or pets are allowed to be inside vehicle at any time.

e. Roof racks of any kind cannot be installed on roof of vehicle.

f. The Driver must be designated on the Rental Agreement, under no circumstances does another person have permission to drive the vehicle.

g. The Driver must be of a minimum age of 25 years old.

h. In the event of an accident the Hirer must immediately contact Drive SA Car Hire in regards to the accident. Contact Police within 24 hours of the time of the accident.

i. In the event of an accident the Hirer must not accept liability for, or offer promise of payment, or waive the cost of damages of the accident. This includes personal or vehicle damage.

j. The hirer will be liable for any towing or salvage costs in the event the vehicle is unable to be driven or not roadworthy due to damage incurred by the Hirer.

k. The vehicle is not to be used to propel or tow another vehicle, boat or trailer under any circumstances.

l. The vehicle shall not be used in any race, rally or similar sporting events.

m. In the event that the vehicle has broken down Drive SA Car Hire will endeavour to get the Hirer back on the road as soon as possible but will not be responsible for the cost of a missed flight, disrupted plans or loss of enjoyment or economic loss to the Hirer.

n. Hirer shall ensure the correct fuel is used in vehicle, and if not, the cost to remove fuel and refill with correct fuel will be incurred by the Hirer.

o. The driver must not be intoxicated or be under influence of any drug, must not in any way have an impairment which will cause danger to the vehicle its occupants and other road users.

p. The Hirer will be liable for costs from any tolls, parking, speeding, traffic light camera fines or any other infringements that has been incurred during the rental period.

q. If vehicle keys are lost or locked in vehicle, the Hirer will be liable for any cost to re-cut keys or to access vehicle.

3. INSURANCE COVER

a. All vehicles are covered with basic insurance with an excess of $3,000.00, The Hirer is able to reduce the excess to $500.00 by paying an extra fee of $16.50 per day (Excess Reduction Insurance).

b. Single vehicle accidents will incur a $3,000.00 excess, where another vehicle is not involved.

c. If the Hirer decides not to take up “Excess Reduction Insurance”, a deposit of $3000 is required, which will be refunded on return of vehicle after satisfactory inspection of vehicle, plus a non-refundable Bank Surcharge of $30.00 will charged.

4. ITEMS EXCLUDED FROM INSURANCE COVER

a. Loss and or damage to vehicle if it is stolen due to the vehicle being left unlocked or keys lost.

b. Damage to vehicle if driven in unauthorized area.

c. The loss or damage to Hirers and passengers personal belongings while in the vehicle.

d. If vehicle is driven in an illegal manner as to cause damage or loss.

e. Damage to vehicle subsequent to a loss of oil or coolant when warning lights have been on, the Hirer must check manufacturers specifications for correct oil to use in engine.

f. Any under body or overhead damage, rear view mirrors damaged, cracks or chips in windscreen or other glass on vehicle.

g. Damage to tyres due to running when flat, it is the Hirers responsibility to maintain tyre pressures at manufacturers specifications.

h. Vehicle is immersed in water due to crossing flooded road or other.

i. Damage to vehicle due to insufficient care when parking or reversing.

5. TERMINATION OF CONTRACT

Drive SA Car Hire reserves the right to terminate the Rental Agreement if any of the following occurs:

a. If false or misleading information has been supplied by the Hirer in the contract.

b. If in Drive SA Car Hires opinion the Driver is deemed to be intoxicated, under the influence of drugs, or seems to be impaired in a way to be a danger on the road.

c. The vehicle be driven by person(s) other than those nominated as the Authorized Drivers on the Rental Agreement.

d. Or in breach, or suspected breach of any Terms and Conditions hereof.

6. RETURN OF VEHICLE

a. The vehicle must be returned to the approved location. If the vehicle has to be retrieved from an unauthorized location a charge will be incurred by the Hirer.

b. There will be no refund on early termination of a Rental Agreement.

c. The vehicle will undergo a final inspection to check for any damage and the Hirer will be liable for any costs incurred for repair of vehicle.

d. The vehicle must be returned with a full tank of fuel otherwise, a charge will be incurred by the Hirer for the approximate cost to fill petrol tank and the time taken to refill at nearest service station.
